ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM
RENZO GRACIE STATEN ISLAND– NEW YORK CITY
1. DISCLAIMER AND EXPRESS ASSUMPTION OF RISK
In consideration of being allowed to participate in any way in the martial arts training, classes, instruction, sparring, open mat sessions, events, and related activities (collectively, the “Activities”) offered by Renzo Gracie Staten Island (“Academy”), the undersigned participant (or parent/guardian if participant is under 18) acknowledges, appreciates, and agrees that:
Inherent Risks: Brazilian Jiu-Jitsu, grappling, and martial arts training involve physical contact and strenuous exercise. The risks include, but are not limited to, severe physical injury, broken bones, sprains, joint dislocations, concussions, skin infections, cardiovascular stress, permanent paralysis, or death.
Voluntary Participation: I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees (defined below) or others, and assume full responsibility for my participation.
2. RELEASE OF LIABILITY AND WAIVER
I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby RELEASE, WAIVE, AND FOREVER DISCHARGE Renzo Gracie Staten Island, its owners, officers, directors, instructors, employees, agents, equipment manufacturers, and owners/lessors of the premises (collectively, the “Releasees”), with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by New York law.
3. MEDICAL FITNESS & CONSENT
I certify that I am in good physical condition and have no medical restrictions that would prevent safe participation in the Activities.
I authorize the Academy staff to seek emergency medical treatment on my behalf if necessary. I agree to be solely responsible for any costs incurred for medical treatment or transportation.
4. MEDIA & PHOTO RELEASE
I grant Renzo Gracie Staten Island Academy the right to photograph, videotape, or record me during Activities and to use my image, likeness, and voice in promotional, social media, or marketing materials without compensation.
5. SEVERABILITY AND GOVERNING LAW
This agreement shall be governed by and construed in accordance with the laws of the State of New York. If any provision of this waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
